California court: Illegal aliens entitled to in-state college tuition

(LA Times) The California Supreme Court decided unanimously Monday that illegal immigrants may continue to be eligible for in-state tuition rates at the state’s colleges and universities rather than pay the higher rates charged to those who live out of state.

In a ruling written by Justice Ming W. Chin, one of the panel’s more conservative members, the state high court said a California law that guarantees the lower tuition for students who attend California high schools for at least three years and graduate does not conflict with a federal prohibition on giving illegal immigrants educational benefits based on residency.

California is one of several states that permit illegal immigrants to take advantage of lower college tuition for students who attend high school and graduate in state. About 25,000 illegal immigrants are estimated to receive in-state tuition rates in California.

Harry Reid promises DREAM Act vote in lame duck session

(The Hill) Senate Majority Leader Harry Reid (D-Nev.) vowed on Spanish-language television to bring the DREAM Act back for a vote in the lame-duck session.

On the Univision program “Al Punto,” Reid was repeatedly hammered by host Jorge Ramos on whether the vote would happen, win or lose on Tuesday.

“The answer is yes,” Reid said.

“I have the right to do that, you know, I have the right to bring that up any time I want, that’s why I brought it up the first time,” he said. “I am a believer in our needing to do something. … We all support the DREAM Act. I just need a handful of Republicans to help me.”

Illegal aliens campaigning for Democrats

(Fox News) When Maria Gianni is knocking on voters’ doors, she’s not bashful about telling people she is in the country illegally. She knows it’s a risk to advertise to strangers that she’s here illegally — but one worth taking in what she sees as a crucial election.

The 42-year-old is one of dozens of volunteers — many of them illegal immigrants — canvassing neighborhoods in the Seattle area trying to get naturalized citizens to cast a ballot for candidates like Democratic Sen. Patty Murray, who is in a neck-to-neck race with Republican Dino Rossi.

I have a major problem with this. Here you have people who are in this country illegally trying to interfere with and manipulate our elections. That’s unacceptable.

AZ illegal alien beheads victim

I suppose this scum was here illegally only to make a better life for himself and his family, isn’t that right you liberals and globalists?

“We don’t go to many cases where the victim has been decapitated,” said Chandler Police Det. Frank Mendoza.

The man police arrested in the case, Crisantos Moroyoqui, 36, is an undocumented immigrant who lived across the way from the murder scene. He rented a bed for $100 a month in a small apartment shared by five other day laborers. He had lived there three months, his roommates said Monday.

Drunk driving illegal alien who killed nun was released by feds while waiting to be deported

This is a sad, infuriating, and preventable story:

A man accused of driving drunk and killing an elderly nun as well as injuring two others in a Virginia crash Sunday is in the country illegally, said an officer from the Prince William County Police Department.

Carlos A. Martinelly Montano, of 12760 Merrymont Lane in Bristow, was in the deportation process when the crash occurred, said Officer Jonathan Perok. The next step is to notify the US Immigration and Customs Enforcement.

The Prince William County PD did notify Immigration and Customs Enforcement who then promptly released him to await deportation. The illegal then went out and drove intoxicated for at least the third time (he was arrested twice before on drunk driving charges) killing an innocent victim and injuring others.

If I were the nun’s family I would sue the federal government. As one Prince William County Board of Supervisors member stated, the federal government “has blood on their hands; if they hadn’t done so [released the illegal alien], this nun would still be alive.”

The real question here is: Why are illegal aliens released while awaiting deportation? That makes no sense. No wonder we’re told we can’t deport them!

But I do think it’s important to remember that illegal aliens come here only to work hard and make a better life for themselves and family. They certainly don’t ever commit crimes, i.e. drink driving. They are all law-abiding (except being here illegally, of course), productive residents…

Judge Susan Bolton’s specious argument for blocking Arizona immigration law

National Review’s Andrew McCarthy has a great post today over at The Corner demonstrating Clinton-appointed Judge Susan Bolton’s specious argument — based on a misapplication of case law — for blocking Arizona’s new immigration law.

There are three key flaws in Judge (so-called) Bolton’s decision:

  1. In essence, Judge Susan Bolton bought the Justice Department’s preemption argument — i.e., the claim that the federal government has broad and exclusive authority to regulate immigration, and therefore that any state measure that is inconsistent with federal law is invalid. The Arizona law is completely consistent with federal law. The judge, however, twisted the concept of federal law into federal enforcement practices (or, as it happens, lack thereof). In effect, the court is saying that if the feds refuse to enforce the law the states can’t do it either because doing so would transgress the federal policy of non-enforcement … which is nuts.

  2. The judge also employs a cute bit of sleight-of-hand. She repeatedly invokes a 1941 case, Hines v. Davidowitz, in which the Supreme Court struck down a state alien-registration statute. In Hines, the high court reasoned that the federal government had traditionally followed a policy of not treating aliens as “a thing apart,” and that Congress had therefore “manifested a purpose … to protect the liberties of law-abiding aliens through one uniform national system” that would not unduly subject them to “inquisitorial practices and police surveillance.” But the Arizona law is not directed at law-abiding aliens in order to identify them as foreigners and subject them, on that basis, to police attention. It is directed at arrested aliens who are in custody because they have violated the law. And it is not requiring them to register with the state; it is requiring proof that they have properly registered with the federal government — something a sensible federal government would want to encourage.

  3. Judge Bolton proceeds from this misapplication of Hines to the absurd conclusion that Arizona can’t ask the federal government for verification of the immigration status of arrestees — even though federal law prohibits the said arrestees from being in the country unless they have legal status — because that would tremendously burden the feds, which in turn would make the arrestees wait while their status is being checked, which would result in the alien arrestees being treated like “a thing apart.”The ruling ignores that, in the much later case of Plyler v. Doe (1982), the Supreme Court has emphasized that:

    Although the State has no direct interest in controlling entry into this country, that interest being one reserved by the Constitution to the Federal Government, unchecked unlawful migration might impair the State’s economy generally, or the State’s ability to provide some important service. Despite the exclusive federal control of this Nation’s borders, we cannot conclude that the States are without power to deter the influx of persons entering the United States against federal law, and whose numbers might have a discernible impact on traditional state concerns. [Emphasis added.]

Arizona Governor Jan Brewer (R) has already filed an expedited appeal with the Ninth Circuit Court of Appeals (the most liberal and, ipso facto, the most overturned appellate court). So don’t be optimistic about this decision getting overturned. Because it won’t–at least not by the Ninth Circus. But then Arizona will appeal to and petition the Supreme Court to take the case. It will because of the case’s national importance . And I believe Arizona will prevail by a 5-4 decision, paving the way for any of the other 49 states to enact replicate legislation.

Obama’s illegal alien Aunt gets political asylum (but Obama had nothing to do with it)

Zeituni Onyango, President Obama’s illegal alien Aunt from Kenya, has been awarded political amnesty as a result of a magical reversal of opinion by the judge in charge of the case.

In case you were unaware of this story, let me bring you up to speed. Here the bullet points:

  • Onyango came to America illegally from Kenya
  • She is living in public housing in the Boston area (more on this below)
  • The same judge who has now reversed his decision initially ordered Onyango to be deported
  • She failed to comply with that deportation order

You’re caught up.

I’ll leave you with a couple of questions:

  1. How is an illegal alien eligible to live in public housing? (This is another  reason why I love Arizona’s new immigration law. That law provides for severe punishment for state social workers who provide illegal aliens with benefits and programs they are ineligible for).
  2. We are told that President Obama had nothing to do with this judge’s dramatic reversal. We’re supposed to believe that?

How long before hate speech laws come to America?

  1. Christian preacher arrested in Britain by a Lesbian, Gay, Bisexual and Transgender liaison (yes, apparently there is such a position on Britain) for violating the Public Order Act by simply saying homosexuality is a sin. My question to you: how long before we have laws against so-called “hate speech” like the Public Order Act here in America? Simply offending or insulting someone would be a crime punishable by imprisonment!
  2. Obama administration now says that failed Times Square terrorist attack might be tied to an international terrorist organization. Well no kidding! Just because the attack was poorly executed and failed doesn’t necessarily dictate that it was committed by a “lone wolf.”
  3. It’s not just Democrats who see granting amnesty to illegals as a way to grow their voter base, some Republicans are taking this view whether they admit or not, including Karl Rove and Jeb Bush.
